General Terms and Conditions (GTC) of GPC Vertriebs GmbH for the online store “Viteeo”

Scope of application
These General Terms and Conditions (GTC) apply to all contracts concluded via the online store www.viteeo.com between the

(hereinafter “Seller”) and the customer.
Customers within the meaning of these GTC are both consumers within the meaning of Section 1 KSchG (hereinafter referred to as “consumers”) and entrepreneurs within the meaning of Section 1 UGB (hereinafter referred to as “entrepreneurs”).
Deviating, conflicting or supplementary terms and conditions of the customer shall not become part of the contract unless the seller expressly agrees to their validity in writing.
Subject matter of the contract
The seller distributes food supplements under the Viteeo brand, in particular “Viteeo Origins – Performance Capsules”, via www.viteeo.com.
The product is not a medicinal product. It is a food supplement based on natural ingredients (4 capsules per pack of 500 mg).
Effect information is based on experience reports and does not represent any medical healing or efficacy promises. The effect may vary from person to person.
Use at your own risk. Pregnant women, nursing mothers, minors, cardiovascular patients and allergy sufferers should seek medical advice before use.
The products must not be used as a substitute for a balanced diet or for medical treatment.
Conclusion of contract
The presentation of the products in the online store does not constitute a legally binding offer, but a non-binding invitation to order.
By clicking on the “Buy now” button, the customer submits a binding offer to purchase.
The purchase contract is only concluded by express confirmation or by dispatch of the goods.
The seller is entitled to refuse orders without giving reasons.
Prices and terms of payment
All prices are in euros, including statutory VAT (where applicable) and excluding shipping costs.
The following payment methods are available:
– PayPal
– Stripe (credit/debit cards)
– Klarna
– Apple Pay
– Google Pay
– Manual bank transfer (dispatch after receipt of payment)
No payment by SEPA direct debit.
Shipment will only take place after full payment has been received.
In the event of late payment, the statutory default interest shall apply (§ 1333 ABGB).
Shipping and delivery
Shipping is EU-wide.
Shipping costs are indicated in the order process and depend on the respective shipping service provider.
Delivery shall be made to the address specified by the customer.
In the case of consumers, the risk of loss or damage to the goods is only transferred to the customer upon delivery (§ 7b KSchG).
For entrepreneurs, the transfer of risk takes place upon handover to the shipping service provider (§ 429 UGB).
The seller is not liable for delays in delivery caused by shipping service providers or unforeseeable events.
Retention of title
The goods remain the property of GPC Vertriebs GmbH until full payment has been made.
Any resale or other disposal of the goods subject to retention of title by the customer requires the express written consent of the seller.
Right of withdrawal for consumers
Consumers have the right to withdraw from the purchase contract within 14 days without giving reasons (§ 11 FAGG).
The period begins on the day on which the consumer receives the goods.
To exercise the right of withdrawal, the consumer must inform the seller of the withdrawal by means of a clear declaration (e-mail or letter).
Sealed food supplements are excluded from the right of withdrawal if the seal has been removed after delivery (hygiene reasons, § 18 para. 1 no. 5 FAGG).
In the event of an effective withdrawal, the seller shall refund all payments made by the consumer, including delivery costs, within 14 days of receipt of the returned goods using the same means of payment.
Warranty and liability
The statutory warranty law according to the Austrian Consumer Protection Act applies.
For entrepreneurs, the warranty period is 12 months from delivery of the goods.
The seller does not guarantee any specific effects or results.
Individual differences in perception or effect do not constitute a defect.
No liability for damage resulting from improper use or non-compliance with the instructions for use.
Liability for slight negligence is excluded to the extent permitted by law.
B2B provisions for entrepreneurs
Entrepreneurs undertake to provide complete company data including a valid VAT number during the ordering process.
There is no right of revocation or withdrawal for entrepreneurs.
For entrepreneurs, the exclusive place of jurisdiction is Linz.
Recourse claims according to § 933b ABGB are excluded.
Entrepreneurs may resell the products purchased from the seller, provided they do so in their original condition and unchanged under the Viteeo brand.
Repackaging, renaming or sale under the seller’s own brand or presentation is expressly prohibited without the seller’s prior written consent.
Entrepreneurs are fully liable for all damages resulting from unauthorized further processing, relabeling or brand use.
Authorized sales partners or resellers can conclude an individual sales partner agreement with GPC Vertriebs GmbH, which regulates special conditions, quantity discounts or marketing rights.
In the event of a breach of these regulations, the seller reserves the right to revoke the sales partner status, claim damages and take legal action for trademark infringement.

Final provisions
These GTC and all contracts shall be governed by Austrian law to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
Should any provision of these GTC be or become invalid, this shall not affect the validity of the remaining provisions (severability clause).
Amendments or additions to contracts must be made in writing.
For consumers, the statutory place of jurisdiction pursuant to KSchG shall apply. For entrepreneurs, the exclusive place of jurisdiction is Linz.
